I, , the undersigned, certify that I am authorized to agree to the provisions of this instrument, and to execute the same, on behalf of , a corporation , its officers and directors, film crew, performers, exhibitors, employees, agents, independent contractors or other affiliates, (hereinafter referred to collectively as Releasor), in consideration of certain officers and directors, film crew, performers, exhibitors, employees, agents, independent contractors or other affiliates of , being permitted to film a on through and including , at the located on the Seminole in the Seminole Indian Reservation, hereinafter Premises, and do hereby acknowledge that such filming events may involve certain risks and consequences, and do hereby voluntarily assume responsibility for such risks and consequences of said officers and directors, film crew, performers, exhibitors, employees, agents, independent contractors or other affiliates of, participating in filming activities in said Premises.
The Releasor hereby knowingly, freely, and voluntarily releases, waives, acquits and discharges the United States of America, the Seminole Tribe of Florida, the Seminole Tribe of Florida, Inc., the Seminole Community, and any of their Tribal Council members, Tribal members, officers, directors, employees, agents, shareholders, and volunteers together with their heirs, personal representatives, successors, assigns, al/ referred to as Releasees, from liability to Releasor for all loss or damage, and any claims therefore brought by, or on behalf of Releasor on account of death, bodily injury, personal injury or property damage.
Releasor agrees to indemnify the Releasees and each of them from any loss, liability, damage or cost Releasees may incur due to presence of said officers and directors, film crew, performers, exhibitors, employees, agents, independent contractors or other affiliates in or on the Premises and during participation in the filming activities whether caused by the negligence of Releasees or otherwise, or by persons who may bean the Premises lawfully or otherwise.
Releasor assumes full responsibility for and risk of bodily injury, death, or property damage due to negligence of Releasees, or otherwise, while said officers and directors, film crew, performers, exhibitors, employees, agents, independent contractors or other affiliates are in or on the Premises and while participating in said filming activities.
Releasor agrees not to institute any action or suit at law or at equity against the Releasees, nor to assist in the institution or prosecution of any claim, demand, action or cause of action for damages, costs, loss of services, expenses, or compensation by any other person or entity, and to indemnify and hold harmless Releasees from any and all claims brought by, or on behalf of said officers and directors, film crew, performers, exhibitors, employees, agents, independent contractors or other affiliates.
Releasor shall be responsible and liable for obtaining any and all appearance/image releases. Releasees reserve the right to have their authorized representative present at the location during filming. Releasor agrees to this reservation of right.
Releasees agree that Releasor may place all necessary equipment on the Premises and Releasor agrees to remove the necessary equipment after completion of work and leave the Premises in as good of condition as when received.
Releasor agrees that this Release, Waiver, and Indemnity Agreement is intended to be as broad and inclusive as permitted by the laws of the United States and the Seminole Tribe of Florida. If any portion of this Agreement is held invalid, it is agreed that the balance shall, not withstanding, continue in full legal force and effect.
Releasor, being fully authorized to do so, in consideration of said officers and directors, film crew, performers, exhibitors, employees, agents, independent contractors, or other affiliates being permitted to attend and participate in the filming activities in the Premises does hereby release and forever discharge said Releasees, their heirs, administrators, and executors of and from any and every claim, demand, action or right of action, of whatsoever kind or nature, either in law or in equity, arising from or by any reason of any bodily injury or personal injuries, known or unknown, death and/or property damages resulting or to result from any accident which may occur as a result of attendance and participation by said officers and directors, film crew, performers, exhibitors. employees, agents, independent contractors, or other affiliates in said filming activities conducted on the Premises whether or not due to the negligence of the Releasees.
The undersigned on behalf of Releasor further states that he/she has carefully read the above Release, and knows the contents of the Release and understands it and has full authority to bind Releasor to its terms and to sign this Release on behalf of Releasor.
This Release contains the entire agreement between the parties to this Agreement, and the terms of this Release are contractual and not a mere recital.
